Backup Policy: Sapphire Hosting will create monthly and incremental backups at $2 a month, or the client can from the hsphere control panel download there entire website to there own pc

SPAM Policy:
Client shall not use the Services for chain letters, junk mail, spamming, or any use of distribution lists to any person who has not given specific permission to be included in such a process. Sapphire may, at its discretion, charge a $200.00 per complaint fee, after the 2nd.

Cancellation:
A client may, at any time, cancel their contract, regardless of the duration of the contract. The first month to include the setup fee is NON-REFUNDABLE. Sapphire will not refund any money for a partially used month. A client must give written notice of cancellation at least 30 days in advance. Failure to do so may result in continued charges.

Bandwidth Usage:
A fee of $5.00 per GB will be charge for each GB over the client's monthly limit. Monthly limits will not carry over to future months. You may, at any time, request to be switched from one level bandwidth to another, but it will not actually take place until your next billing month.

Billing and Payment:
Sapphire does accept check payment for servers, however payment must be made quarterly and paid in advance. All payments are expected within 7 days of the invoice date. Initial accounts are charged before setup occurs. Initial month and setup fees are non-refundable.

Pricing and Contracts:
Pricing for servers remains effective on a year to year basis, renewable in the month prior to the initial setup month. These rates are locked in place and cannot be changed. If a client wishes to change his pricing, he must do so in the month prior to his setup month.

Disclaimer of Warranty:
THE SERVICES, THE SAPPHIRE HOSTING SITE, INCLUDING WITHOUT LIMITATION, ALL PRODUCTS AND SERVICES DISPLAYED OR OFFERED ON THE SAPPHIRE SITE, AND ALL TEXT, GRAPHICS, LINKS AND APPLICATIONS ARE PROVIDED TO CLIENT ON AN 'AS IS' BASIS AND WITHOUT WARRANTY OF ANY KIND. SAPPHIRE DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, WITH RESPECT TO EACH OF THE FOREGOING, WITHOUT LIMITATION, ANY WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT OR ARISING FROM A COURSE OF DEALING. WITHOUT LIMITING THE GENERALITY OF THE FOREGOING, SAPPHIRE SPECIFICALLY DISCLAIMS ANY WARRANTY THAT (1)THE SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE; (2) DEFECTS WILL BE CORRECTED; (3) THERE ARE NO VIRUSES OR OTHER HARMFUL COMPONENTS; AND (4) THE SECURITY METHODS EMPLOYED WILL BE SUFFICIENT.

Limitation of Liability:
IN NO EVENT SHALL SAPPHIRE BE LIABLE FOR DAMAGES RESULTING FROM LOSS OF DATA OR REVINEW, PROFITS, USE OF THE SAPPHIRE SITE OR ANY SAPPHIRE PRODUCTS OR SERVICES, OR FOR ANY INCIDENTAL, INDIRECT, PUNITIVE, OR CONSEQUENTIAL DAMAGES IN CONNECTION WITH THIS AGREEMENT OR IN CONNECTION WITH ANY PRODUCTS OR SERVICES PROVIDED HEREUNDER. IN NO EVENT SHALL SAPPHIRE CUMULATIVE LIABILITY EXCEED AN AMOUNT GREATER THAN FIVE HUNDRED DOLLARS ($500 US).

Client Liability and Indemnification:
The client agrees that in no event shall Sapphire be liable to any third party for client's breach or alleged breach of any of the terms and conditions set forth in this Agreement. Client agrees to defend, indemnify and hold harmless Sapphire from any and all expenses, losses, liabilities, damages or third party claims resulting from client's breach or alleged breach of any client obligations set forth hereunder.

Terms of Service Changes
These Terms and Conditions can change at anytime. Clients will be bound by the new changes. It is the clients responsibility to frequently check here for any changes. Sapphire will post a message in it's helpdesk announcements section, concerning these changes.. Changes can be made that need to suit clients, but must be written and signed by both parties.
